Where
censorship is essential, it may be preferable to introduce
post-effective censorship with damages or penalties, 'judged' by a
jury – as is the case with Defamation and Obscenity laws at the
moment in England – rather than using less 'democratic'
pre-effective censorship by administrative or quasi-judicial process
(as is the case in England now for films).
